WHAT IS NDH-4?

 

In simple words it is a declaration as Nidhi Company or Updation of status by Nidhi.NDH-4 is required to be filed pursuant to section 406 of the Companies Act, 2013 and rules 3A, 23A, and 23B of Nidhi Rules, 2014.

(1st case)

(New Nidhi Rule 2022) If Nidhi company is new so what the time period of filling NDH-4?

If the company is incorporated after April 19, 2022, you will have to apply for NDH-4 within 120 days (4 months) of your incorporation date.

(2nd case)
If Nidhi company is old so what the time period of filling NDH-4?

If the company is old then you have to apply for Form-4 within 60 days (2 months) of the end of the financial year.

NDH-4 how much time does it take?

The total time period is 45 days, during which you get approval or rejection of NDH-4.

If NDH-4 rejected?

NDH-4 form is the central government approved form. If your NDH-4 is rejected then you will not be able to do any work in this Nidhi company means you will not be able to receive deposits or provide loans to your members.

  1. It should not be more than 7.5% deposit (In Current A/C ) [RATE OF INTEREST]

  2. Deposit which should not be more than 2%(In Saving A/C )

What is the main condition for apply NDH-4?

LIST OF DOCUMENTS REQUIRED :

  1. Minimum 200 members should be there before completion of 1 year within the company.

  2. Your share capital should be at least Rs 10 lakh.

  3. NOF (Net Owned Fund) should be 20 lakhs and its ratio should be in (1:20).

What happen if these conditions arenot fulfilled by nidhi company?


If the NidhiCompany has failed in all the conditions or has not been able to fulfill any one of these conditions even after completion of 1 year, then you can ask for some extra time from the Regional Director. What to do for him? For that you will have to fill NDH-2

What is NDH-2 ?


In NDH-2(Extension of time) we inform the Regional Director that our NidhiCompany has 200 members or any of the conditions have not been fulfilled in 1 year, some more time is required to fulfill those conditions. After applying this form, the Regional Director analyzes and if he feels that you deserve time, then he extends the time for you.

NDH-2 time period for filling?


We can also file NDH-2 only when our company has been established for 1 year or the members are still 197 but you have 3 members available to add but you are thinking that 1 year should be completed. What to do now, so don't worry about it (NDH-2 can be applied within 30 days after completion of 1 year.)

Documents of NDH-4?

  1. Copy of Resolution of the Board of directors

  2. - Certificate signed by 2 directors (In this we confirm that our company has reached 200 members within 1 year)

  3. Certificate from the Auditors of the company.

  4. - Copy of notification through which company as declared Nidhi under the company Act 1959
